Welcome to Social Analytics. By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
1. Definitions
- "Platform" refers to the Social Analytics web application, APIs, and all related services
- "User", "you", "your" refers to the individual or entity accessing the Platform
- "We", "us", "our" refers to Social Analytics and its operators
- "Connected Account" refers to a social media account linked to the Platform via OAuth or API credentials
- "Content" refers to videos, posts, and other media tracked through the Platform
2. Account Registration
To use Social Analytics, you must create an account and provide accurate information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access
- Ensuring you are at least 13 years of age
3. Subscription Plans
Social Analytics offers multiple subscription tiers (Free, Starter, Pro, Business, Enterprise). By subscribing to a paid plan:
- You agree to pay the applicable fees as displayed at the time of purchase
- Subscriptions renew automatically unless cancelled before the renewal date
- Upgrades take effect immediately; downgrades take effect at the next billing cycle
- Refunds are handled on a case-by-case basis within 14 days of purchase
- We reserve the right to modify pricing with 30 days notice
4. Acceptable Use
You agree not to:
- Use the Platform for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to other users' accounts or data
- Interfere with or disrupt the Platform's infrastructure
- Scrape, crawl, or use automated tools to extract data from the Platform
- Resell, redistribute, or sublicense access to the Platform without authorization
- Use the Platform to violate any third-party platform's terms of service
- Exceed the API rate limits or usage quotas of your subscription plan
5. Connected Social Media Accounts
When connecting social media accounts to the Platform:
- You represent that you have the authority to connect and access the account
- You grant us permission to access analytics data through the platform's official APIs
- We only request read-only permissions — we will never post, modify, or delete your content
- You may disconnect any account at any time through your dashboard
- We are not responsible for changes to third-party API availability or data access
6. Data Ownership
You retain full ownership of your social media content and analytics data. By using the Platform, you grant us a limited license to:
- Access, process, and display your analytics data within the Platform
- Generate insights, recommendations, and reports based on your data
- Store your data securely for the duration of your subscription
We do not claim ownership of your content or data. Aggregated, anonymized data may be used to improve the Platform.
7. Intellectual Property
The Platform, including its design, code, features, branding, and documentation, is owned by Social Analytics and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform.
8. Limitation of Liability
To the maximum extent permitted by law:
- The Platform is provided "as is" without warranties of any kind
- We do not guarantee the accuracy, completeness, or timeliness of analytics data
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount paid by you in the 12 months preceding the claim
- We are not responsible for third-party platform outages, API changes, or data loss
9. Service Availability
We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect access. We will notify users in advance of planned downtime when possible.
10. Account Termination
- You may delete your account at any time through your account settings
- We may suspend or terminate accounts that violate these Terms
- Upon termination, your data will be deleted within 30 days
- Prepaid subscription fees are non-refundable upon termination for violation
11. Dispute Resolution
Any disputes arising from these Terms shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with applicable laws. You agree to waive any right to participate in a class action lawsuit.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
